High Court Proceedings against the Education Authority

Our office have today issued Human Rights Act proceedings in the High Court against the Education Authority in relation to a child who has missed a significant amount of education/SEN.

The child was not able to attend school, and was not given any form of education whilst at home.

The proceedings are seeking an award of damages from the EA for failing to educate the child over an extended period of time. The EA have legal obligations towards children with SEN, and when they are breached one remedy is to seek a declaration from the High Court that their human right to education has been denied, with compensation to the child to assist in trying to make up for that loss.
